These Terms of Service (“Terms”) govern your use of the Mimzy mobile application (“Mimzy”, “the app”, “the Service”) operated by Webfluence (“we”, “us”, “our”). By downloading, installing, or using Mimzy, you agree to these Terms. If you do not agree, please do not use the app.
1. The Service
Mimzy is an AI-powered personal dream journal and wellness companion. The app lets you:
- Log dreams by voice or text
- Receive AI-generated interpretations across multiple cultural and psychological traditions
- Keep a private journal of your dreams and see patterns over time
- Engage in guided wellness consultations and receive personalised insights
- Share beautifully-designed cards of your interpretations
All interpretations, wellness insights, and suggestions generated by the app are produced by large language models and are intended for self-reflection and personal interest only.
2. Eligibility
You must be at least 13 years old (or 16 in the European Economic Area) to use Mimzy. By using the app, you represent that you meet this age requirement. If you are under 18, use Mimzy with a parent or guardian’s permission.
3. Your account and data
Mimzy does not require an account to use. Your dreams, wellness sessions, and preferences are stored on your device. You are responsible for backing up the device and for keeping it secure. If you uninstall the app or reset your device, your data will be erased and cannot be recovered by us.
4. Acceptable use
You agree to use Mimzy for lawful personal purposes only. You agree NOT to:
- Submit content that is illegal, harassing, threatening, hateful, sexually explicit towards minors, or that infringes anyone’s rights
- Attempt to reverse-engineer, decompile, or tamper with the app
- Try to overload, break, or abuse our AI API integrations
- Use Mimzy to impersonate any person or organisation
- Use Mimzy for commercial redistribution without our written permission
We reserve the right to rate-limit, restrict, or terminate access for users who violate these Terms.
5. AI-generated content — important
Dream interpretations, wellness insights, and other AI output in Mimzy are not medical, psychological, psychiatric, religious, or professional advice. They are written by an AI language model for self-reflection and entertainment.
- Do not rely on Mimzy to diagnose or treat any medical, mental-health, or spiritual condition.
- Do not substitute Mimzy for care from a qualified professional.
- If you are experiencing distress, crisis, suicidal thoughts, or any serious concern, please contact a licensed professional, your local emergency services, or a mental-health helpline immediately.
By using Mimzy you acknowledge that AI output can be inaccurate, incomplete, or inappropriate, and you use it at your own discretion.
6. Intellectual property
- The app, its design, code, logos, and content (excluding your dream entries) are owned by Webfluence and protected by applicable copyright, trademark, and other intellectual-property laws.
- You retain full ownership of the content you create — your dreams, wellness answers, and notes.
- By using the app you grant us a limited licence to process your inputs through Google’s Gemini API for the sole purpose of delivering the feature you requested (interpretation, insight). We do not claim any ownership of your dream content.
7. Subscriptions (future)
Mimzy may in the future offer optional paid subscriptions. If and when they become available:
- Billing is handled entirely by Google Play Billing. We do not see or store your payment details.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- You can cancel at any time in your Google Play account settings.
- Refund requests are handled per Google Play’s refund policy.
- Free trials convert to paid subscriptions unless cancelled before the trial ends.
- Prices may vary by region and may change with notice.
8. Advertising
Mimzy is supported by advertising provided by Google AdMob. By using the app you agree to see ads that may use your Advertising ID. You can reset or limit ad personalisation on your device at any time via your phone settings.
9. Third-party services
Mimzy integrates with third-party services (Google Gemini, Firebase, AdMob, Play Services, etc.). Your use of those services is subject to their own terms and privacy policies, linked in our Privacy Policy.
10. Availability and updates
We strive to keep Mimzy available but make no guarantees of uninterrupted service. We may release updates, change features, or discontinue features at any time. Some AI features depend on third-party APIs (Google Gemini) whose availability is not under our control.
11. Disclaimer of warranties
Mimzy is provided “as is” and “as available” without warranty of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI-generated content.
12. Limitation of liability
To the maximum extent permitted by law:
- Webfluence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Mimzy.
- Our total aggregate liability for any claim arising out of or related to these Terms or the app shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $50.
Some jurisdictions do not allow certain limitations, so these may not apply to you.
13. Indemnification
You agree to indemnify and hold Webfluence harmless from any claim, demand, or damages arising out of your breach of these Terms, your misuse of the app, or your violation of any law or third-party right.
14. Termination
We may suspend or terminate your access to Mimzy if you violate these Terms. You may stop using the app and delete it at any time. Sections that by their nature should survive termination (IP, disclaimers, limitation of liability) will survive.
15. Governing law and disputes
These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or Mimzy shall be subject to the exclusive jurisdiction of the courts located in India. If you are a consumer resident outside India, this does not deprive you of the protection of mandatory consumer-protection laws of your country.
16. Changes to these Terms
We may update these Terms as the app evolves. Material changes will be notified in-app and the “Last updated” date above will change. Continued use after an update constitutes acceptance of the revised Terms.
